Birmingham, AL – April 30, 2013 – After the first trial ending in a hung jury, Kenneth Smith faces a retrial in the 2008 shooting death of 67-year-old Jimmy Tanks of Choctaw County, AL, that stemmed from a repossession of a Chrysler Sebring.
With the jury chosen on Monday in this case of a repo gone bad, Kenneth Smith of Birmingham is once again on trial for charges in the 2008 shooting death of 67-year-old Jimmy Tanks that occurred during the early morning hours at Tanks’ house in the Halsell community.
Family members claim that the incident started when Tanks heard something outside at approximately 2:30 AM. Tanks grabbed a gun, walked out the back door and confronted who he thought was a thief trying to steal his Chrysler Sebring. In reality it was a Repo Man and two helpers trying to tow off the Chrysler Sebring.
Tanks allegedly fired a shot in the air. Shots were returned and Tanks wound up dead. It may be the only known case of a man killed over a Chrysler Sebring.
“The family, we just all want the right thing done. We’re just looking for that. If we can get that I guess that we’ll have our satisfaction,” says Tanks’ brother, Hollis Pritchett.
Smith’s previous trial in the case ended in a hung jury. His new murder trial will continue Tuesday in Choctaw County Circuit Court.
