HELP !!! The Recovery Industry is Under Major Attack!!!

A large national forwarder is attempting to change 493

Fellow recovery agents, just like they tried last year, a large national forwarder is attempting to change 493 and attempting to create an exemption for themselves from licensure!

For the second year in a row they are attempting to change the definition of what a recovery agency is. They claim that they are not a recovery agency yet in the State of Michigan, in front of a Michigan state Supreme Court Judge they testified under oath that they ARE a recovery Agency!

They claim that because they “DO NOT TOUCH THE METALl” they are not a recovery agency.stop_ul_act

The legislative session this year is very short, in fact it ends on March 01, 2016.

They are putting a lot of pressure this year to get their Bill passed into law. If it does they will be able to operate unlicensed in Florida and you won’t! You can be punished and fined by the state and they won’t!

Is that fair?

We say either regulate equally across the board or do not regulate at all.

We have a fighting chance to stop this Bill but without your help it becomes much harder.

What can you do you ask… It is really very simple.

On your letterhead, company or personal, we need you to write a very simple letter explaining that this Bill is BAD for the industry and it should not be allowed to pass into law.

Really simple.

Fax or email me you letter so we can send it to our lobbyist in Tallahassee. We need to do this NOW, for the next committee meeting this Thursday at 9am!

Here are some of the points on what the bill, how the Bill will affect 493 and our industry.

  • Forwarders will not be required to be licensed…but you will still be required.
  • The division can enforce administrative action upon you for their mistakes but they will be untouchable by the state under this new exemption.
  • Forwarders will be allowed to perform “Private Investigation” activities – Skip tracing – without a license. You will be required to be licensed!
  • Consumers who are harmed by a forwarders mistakes or gross misconduct will not be able to file a complaint with the department to follow up and enforce the rules upon a forwarder. But they will be able to come after you!
  • The exemption of this new bill will endanger the public as it will allow unknown, untrained and unqualified person to conduct recovery agency activities with out a license. Can you imagine how many dangerous criminal would jump on this kind of opportunity?

Forwarders and Forwarding is not going away but if they wish to operate in Florida then they should be licensed just like you and I are required to be.

EITHER REGULATE FAIRLY AND EQUALLY OR DO NOT REGULATE AT ALL

NO MORE “R” AGENCY LICENSING!
