Most bankruptcy training focuses on handling cases during bankruptcy. How to analyze a case. How to get the best deal. How to avoid getting sued. But what happens when the case is over — especially if there will be a continued relationship with the debtor?
What happens when the debtor still has the collateral but did not reaffirm? How should it be reported while payments are being made? What happens if payments are missed? What happens if insurance lapses?
What about mortgages and HELOCs? What happens if the mortgage was current when the bankruptcy was filed and payments were kept current; was the debt discharged? What happens if, after the bankruptcy, a payment becomes due? Must there be any special handling? May you do a workout agreement if you and the debtor agree? May you rewrite the mortgage? May you rewrite the mortgage when a balloon payment becomes due?
If the debtor had a balance on a credit card when the bankruptcy was filed, did not reaffirm, but continued paying and incurring charges; is the balance collectible?
