IMPORTANT NEW CALIFORNIA DEBT COLLECTION ISSUES
Consumer financial institutions that conduct significant collection activities in California (whether or not you have offices in California) should be aware of two important developments in the law that may affect the way you do business — one of which is likely to lead to class litigation in the coming months.
. . • . New licensing requirements take effect later this year. (You may think you are exempt, but it is not at all clear that you are.)
. . • . A recent appellate court decision, if correct, would very likely prevent you from using collection agencies, repossession agencies, certain types of mailing services, and other third party services. Even the court that made the decision agrees it could upend the industry. Contrary to rumor, the case does not just affect collection agencies and it really is that big of a deal!
More information is needed with respect to both, but credit unions, banks and finance companies that do business in California, together with their attorneys, should be aware of these emerging issues and should be planning for them now.
