CDC issues another eviction moratorium

The CDC has issued another moratorium on evictions. This one is focused in counties that are experiencing substantial and high coronavirus transmission using their cases per hundred thousand formula. This new targeted relief follows the expiration of the previously expired moratorium, which the Supreme Court had already ruled unconstitutional, a fact acknowledged by the Biden administration

The new moratorium is scheduled to expire on October 3rd. Worthy of noting is their intent that this will allow for additional time for an additional $40B in rent relief to reach renters and to further increase vaccination rates.

The new ban covers parts of the United States that are experiencing what the CDC calls “substantial” and “high” levels of the coronavirus. As of Tuesday afternoon, that’s the majority of U.S. counties.

Since that moratorium’s expiration in July, progressives had pressured the Biden administration to extend the pause on evictions. The administration previously said it didn’t have the legal authority to issue a such a measure. 

Legal challenges will surely follow as the Supreme Court had already voted 5-4 vote to rejected it in June following an emergency request from a group of landlords who sought to have the eviction ban lifted. In addition, Of note, the 6th Circuit Court of Appeals had also found the CDC’s original eviction moratorium unlawful in July and agreed with a lower court that the agency had stepped outside its authority with the ban.
